Terms of Service
These terms are an agreement between you and Firm Air LLC ("we", "us") covering your use of Bing-O — the iOS app (the "service"). By creating an account or playing, you agree to them.
1. Who can play
You must be at least 13 years old to use the service. If you are under the age of majority where you live, you need a parent or guardian's permission.
2. Your account
Keep your credentials to yourself; you are responsible for activity under your account. Give us accurate information, and don't impersonate anyone. You can delete your account at any time from Profile → Delete account — see the Privacy Policy for exactly what deletion does.
3. Your content
You own what you write — chat messages and bingo phrases. You give us a non-exclusive, worldwide license to host, store, and display that content to the participants of your games, because that's how the service works. Delete your account and this license ends for your personal content as described in the Privacy Policy.
4. House rules
Don't use the service to:
- harass, threaten, or abuse other players, or post content that is illegal, hateful, or sexually explicit;
- cheat, exploit bugs, use automation to play, or interfere with games or other players' experience;
- probe, overload, or disrupt the service, scrape it, or attempt to access accounts or data that aren't yours;
- violate any applicable law.
Game creators can remove players from their games. We may remove content or suspend or terminate accounts that break these rules.
5. Virtual items
XP, levels, streaks, badges, and Bing-Bucks are gameplay features with no monetary value. They can't be bought, sold, transferred, or redeemed, and we may adjust or reset them (for example, to fix bugs or address cheating).
6. The service
We work on Bing-O continuously and may add, change, or remove features, or discontinue the service, at any time. We aim for high availability but the service is provided without uptime guarantees.
7. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, Firm Air LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost data or profits, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of US $10 or the amount you paid us in the past twelve months (currently: nothing — Bing-O is free).
9. Changes to these terms
If we make material changes, we will update this page and its date and call the change out in the app. Continuing to use the service after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the United States and the state in which Firm Air LLC is organized, without regard to conflict-of-laws rules.
